Judge Excludes Confession of Guantanamo Detainee From Trial

Confession obtained using threat of death amounted to torture

Army Col. Stephen Henley, the judge, ruled that extracting a confession under threat of death met the definition of torture under the Guantanamo trial rules -- an "act specifically intended to inflict severe physical or mental pain and suffering."

Mohammed Jawad's confession to Afghan police was obtained through torture and cannot be used as evidence in his trial on charges of wounding U.S. soldiers with a grenade. Reuters has more here. See the Jurist article here.
